These Terms of Service (“Terms”) govern your access to and use of nomly.aiand the Nomly platform (collectively, the “Service”), operated by Crave Up Inc (“Crave Up,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Use of the Service
You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service in any way that violates applicable law or regulation
- Attempt to gain unauthorized access to any portion of the Service or its related systems
- Reverse engineer, decompile, or otherwise attempt to extract the source code of the Service
- Use the Service to transmit unsolicited commercial communications in violation of applicable law
- Interfere with or disrupt the integrity or performance of the Service
2. Accounts
If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@nomly.ai of any unauthorized use of your account.
3. Intellectual property
The Service and its content — including but not limited to text, graphics, logos, and software — are owned by or licensed to Crave Up Inc and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use Crave Up's or Nomly's trademarks, logos, or other proprietary materials without our prior written consent.
4. Customer data
When you use the Service, you may provide or generate data related to your business (“Customer Data”). You retain ownership of your Customer Data. By using the Service, you grant Crave Up a limited license to process your Customer Data solely to provide and improve the Service. We will handle your data in accordance with our Privacy Policy.
5. Third-party services
The Service integrates with third-party tools and data providers. Your use of those services is governed by their respective terms and privacy policies. Crave Up is not responsible for the practices of any third-party service.
6. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRAVE UP INC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRIOR TO THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).
8. Indemnification
You agree to indemnify and hold harmless Crave Up Inc and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service or your violation of these Terms.
9. Termination
We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination will survive, including Sections 3, 6, 7, and 8.
10. Governing law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware.
11. Changes to these Terms
We may update these Terms from time to time. We will post the revised Terms on this page with an updated effective date. Continued use of the Service after changes constitutes your acceptance of the updated Terms.
